China aborts crime against foetus
Beijing: China’s legislature has scrapped an amendment to the criminal law that would ban abortions based on the sex of the foetus, state media reported on Sunday, despite a growing population imbalance between males and females. Members of the national legislature’s standing committee were divided over criminalising sex-selective abortions and removed the provision from a draft amendment on Saturday, the China Youth Daily said.
“Many controversies remain,’’ the Xinhua News Agency said.
The original amendment, last discussed by the National People’s Congress committee in April, called for fines and prison terms of up to three years for aborting a foetus because of the sex for non-medical reasons, the reports said.
A three-decade-old policy limiting most couples to one child has made abortion a widely used method for controlling family size. As a result, and due to a traditional preferences for sons, China faces a growing population imbalance, with many more boys than girls.
Xinhua said there are now 119 boys born for every 100 girls, a larger gap than the government’s previously published figure of 117 to 100. Globally, the average ratio is about 105 boys to 100 girls.
Chinese law does not currently outlaw abortions to select a child’s gender. A family planning regulation prohibits the practice except for medical reasons, but the regulation does not spell out punishments.
Family planning experts and some legislators have argued that the lack of clear criminal penalties has encouraged the use of abortions by families who want a son.
Over the past two years, in the northern province of Hebei next to Beijing, authorities found 848 violations of the rules and closed down 201 clinics that had performed unauthorised sex-selection abortions, state media have reported.
Meanwhile, lawyers defending a blind rural activist detained after he exposed forced abortions and sterilisations have been thwarted in their efforts to sue over veiled threats to his life, a member of the defence team said.
Li Jinsong, who was briefly detained himself and received a threatening phone call after visiting his client in custody last week in eastern Shandong province, said on Sunday a policeman had warned the 34-year-old human rights activist, Chen Guangcheng, that prison was a dangerous place.
Chen has been under house arrest or in detention since September.

Makes me shudder too... as a mother I cant imagine what kind of people can find out the sex of a child and kill it. I spent 9 months and now the last year guarding my child with my life. Makes one think of how human nature can get so completely perverted that a mother... or a father... either parent... can plummet so low as to do the exact opposite of what they are meant to.
I agree that aborting pregnancy just becase you dont like the sex of the baby is unforgivable.
But how would you legislate it? I think in India it's illeagal to find out the sex of the baby. But it's it an assalt on the freedom of a person? If technology allows it why not find it? I am just pointing out the argument, I actually don't know how to solve it.
I think abortions in India are legal. Should one make them illegea? How would be find the difference between abortions that are needed for medical reasons and that are done to avoid a girl child. Banning abortions is not an options because some might be needed to save mom's life.
How about not controlling anythign and let people do whatever they want until the time when the imbalance between men and women is so huge that people start wantign to have girls?
As I said, I don't know the answers but only have questions!
Now I know why it's harder for men to get a date :-).
On a more serious note though, what's the alternative? Parents who ill-treat their daughters? Sell them as slaves ? Or get them married at young ages to men twice their age who abuse them?
It's hard to decide which is the greater evil.
tmm: What amazes me is the fact that they kill the very species that at some point in the future would have propogated to give birth to a son somewhere else...
twisted DNA: But if we were that sorted out to use a choice for the real reason, we would not need legislation, would we? You mentioned banning abortions.. China has removed the ban... which is likely to skew the ratio further... Imagine if every single couple in China now did. a few years from now there would only be boys.. and their very reason for having a boy (ie to propogate) would not be possible..
Surya: Do parents do this because they actually think their daughters would be better off than with their parents?
